NAFDAC Arraigns Trader For Assaulting Officials

The National Agency for Food and Drug Administration and Control ( NAFDAC)  at the weekend arraigned a trader, Biodun Ilesanmi, before the Federal High Court, Lagos, for willful obstruction of its officials who went to Mile 12 Market, Lagos, on inspection, from carrying out their duties.

According to the prosecution counsel, Umaru Shamaki, Ilesanmi prevented members of the Federal Task Force on Counterfeit, Fake Drugs and Unwholesome Processed Foods, working in conjunction with NAFDAC, from ascertaining the genuineness of food products sold in the market.

In the two-count charge, the accused, who owns and operates Shops 28 and 29 in the popular Mile 12 Market, committed the offence on September 3, 2015.

The second count said Ilesanmi obstructed officers of NAFDAC in the course of their duties.

Shamaki, who signed the charge on behalf of the Attorney-General of the Federation, said the offence was in  contravention of Section 2 (1)(a) and is punishable under 11 (2) of the Counterfeit and Fake Drugs and Unwholesome Processed Foods (Miscellaneous Provisions) Act, Cap C34, Laws of the Federation of Nigeria, 2004.

The offence also violates Section 25 of NAFDAC Act, Cap N1, Laws of the Federation of Nigeria, 2004.

The accused person pleaded not guilty when the charges were read to him. His counsel, Olugbenga Onalaja, moved an oral application for the bail of his client, but the prosecution objected.

Justice Mohammed Yunusa adjourned the matter to September 16, 2015 for hearing of Ilesanmi’s bail application. The judge ordered that the accused be remanded in prison custody.

NAFDAC officials were attacked by hoodlums and traders last week at various locations in Lagos during a raid in respect of suspected fake and unregistered vegetable oil in circulation. A female staff of the agency and mobile policeman attached to one of the teams were assaulted allegedly at the instigation of the accused.
