A 60-year-old man, Olayinka Onafuye, who allegedly defrauded an accommodation seeker, Emeka Eze, of N150,000, was on Monday docked before a Surulere Chief Magistrates’ Court in Lagos.

Onafuye, who lives at No. 4, Alhaji Ajana Street, Orile Iganmu, Lagos, is facing a two-count charge of obtaining money under false pretences and stealing.
The Prosecutor, Inspector Gabriel Ekundayo, told the court that the accused committed the offences at No. 4, Alhaji Ajana Stret, Orile Iganmu, Lagos, at about 11:30a.m. on January 16.

Ekundayo said that Eze, who lives at Block 411, Flat 5, Mile 2 Estate, Lagos, reported that the accused collected N150, 000 advance payment out of N240, 000, for a room apartment.
He said that since the complainant paid the money, he has not been given the room and all efforts to recover the money proved abortive.

Ekundayo added that the offences contravened Sections 312(1) and 285 of the Criminal Law of Lagos State, 2011.

The accused, however, pleaded not guilty.

The Chief Magistrate, Mrs M.I. Dan-Oni, granted him bail in the sum of N50,000 with one surety in like sum.

Dan-Oni said the surety should reside within the jurisdiction of the court and must be gainfully employed.

The case was adjourned till April 7 for mention.
