Kogi Assembly To Sue Dogara Over NASS Takeover

Following the resolution of the House of the Representatives to take over the functions of the Kogi State House of Assembly, the Assembly faction led by its Speaker, Hon. Umar Imam, has also resolved to charge Yakubu Dogara, the Speaker of the House of Representatives, and Parry Iriase, chairman of the House fact-finding committee on the crisis, to court for contempt in the decision to seal the Assembly complex and take over its functions.
The Assembly reached the decision at its plenary at the chamber of the Assembly despite the House of Representatives directive on Wednesday that the premises should be sealed.
At the plenary, with Imam presiding, Hon. Friday Sani, the majority leader, moved the motion under matters of urgent public importance that the “legal representatives of the leaders of the House be mandated to file a contempt of court charge against the Speaker of the House of Representatives, chairman and secretary of the purported ad hoc committee of the House of Representatives.”
He also moved for the rejection of the decision of the House of Representatives considering the provision of Section 11(5) of the constitution.”
The lawmaker said the lower chamber of the National Assembly was wrong to have relied on a part of the Constitution for its acts, saying: “For the purpose of sub-section 4, a House of Assembly shall not be deemed to be unable to perform its function so long as the House of Assembly can hold meeting and transact the Assembly business.
“This is in addition to the matter filed by the leadership of this House at the Federal High Ciurt, Lokoja, with suit no FHC/LKJ/CS/16/16 and for which notice was granted by the court dated 1st March 2015–6th April”.
Sani said the action of the House of Representatives demonstrated special and vested interest, adding that the development was part of the plot of Mr. James Faleke to bring down the administration of Governor Yahaya Bello.
Contributing, Hassan Bello from Ajaokuta constituency, said the resolution of the House of Representatives should be discountenance with the lower chambers asked to retract itself on the matter.
According to him, the legislature should not be dragged into the crisis in the executive arm of government, and the House of Representatives must rescind its decision and respect itself.
