Jos Federal High Court Strikes Out Case Against Law Maker

JOS – A Jos division of the Federal  High Court  on Monday struck out a pre-election matter pending before it against Hon. Suleiman Yahaya Kwande representing Jos North\ Bassa  Federal Constituency at National Assembly.

Hon. Ibrahim Dasuki Na Kande, had in a suit no. FHC/J/CS/2/2015, challenged Kwande’s return as the validly elected candidate of the All Progressives Congress (APC) on the ground that the primary election was marred by irregularities.

Kwande is a lawmaker representing Jos-North/Bassa Federal constituency in the House of Representatives.

The court presided over by Justice D. Y. Agishi, struck out the matter on grounds of  none appearance of the plaintiff.

The defence counsel had in an application sought that  the matter to be struck out , a plea that was  granted by the court.

In her ruling, Justice Agishi, said since the plaintiff have not been putting appearances after some adjournments, the matter  was struck out.

She awarded the some of N50,000 as cost against the plaintiff.

Lead counsel to the defendant ,Barrister Tony Agaga,  told Independent  that the plaintiff had lost interest in the matter, and therefore; “we plead for the matter to be struck out.”
