The continued stay of Amina Zakari as the acting Chair of the Independent National Commission (INEC) has been described as unconstitutional as her appointment as a National Commissioner elapsed on Wednesday, July 22nd.

According to an authoritative source at the Commission’s headquarters in Abuja her appointment as a National Commissioner having elapsed, she has no further business being in the Commission.

His words; “It is by virtue of her appointment as a National Commissioner that she was appointed to act as the Chairman and now that her appointment has elapsed she ceases to be a member of the Commission.

“These were the things that the former Chairman Prof. Attahiru Jega took into consideration when he handed over to Mohammed Wali whose tenure would elapse by August, at least, that would have given the new administration time to settle down and make fresh appointments of Commissioners and the Chairman as most of them would have finished their tenures.

He pointed out that “we are watching to see what the President would do because as long as we are concerned she has finished her tenure and can no longer continue as acting Chairman” he declared.

It would be recalled that a few hours after Professor Jega bowed out as Chairman of the Independent National Electoral Commission(INEC), President Muhammadu Buhari appointed Zakari as the Acting Chairman of Commission.

The new chairman of the Commission was made public by the Head of the Civil Service of the Federation, Danladi Kifasi, through a statement by the Director of Communications, Office of the HoS, Haruna Imrana.

In the terse statement,Buhari said Zakari’s appointment was with immediate effect from 30th June 2015 until the appointment of a substantive Chairman for the Commission.
Until her appointment as Acting Chairman, Zakari was a National Electoral Commissioner at INEC.

Earlier on Tuesday,Prof Jega had handed over to Mohammed Wali, a national commissioner of INEC,following the expiration of his tenure.

Wali hails from Sokoto State, but his five-year tenure would have also expired on August 11, 2015.

Jega was appointed chairman of the commission by immediate past President Goodluck Jonathan on June 30, 2010.

The former chairman supervised the conduct of the 2011 and 2015 general elections.
