CLO Calls On NJC To Investigate Enugu Election Tribunal

The Civil Liberties Organisation (CLO) has called on the National Judicial Council (NJC) to investigate Enugu State Election Petition Tribunal, looking critically at its activities and rulings, to ensure their compliance with the provisions of Electoral Act.

In a statement by its Enugu State Chairman, Comrade Zulu Ofolue, on Tuesday, CLO noted that it has been closely monitoring the trend of the 2015 Election Petition Tribunal in the State and wishes to express concern on some of the decisions so far taken by the Tribunal.

The rights group observed that most petitions have been dismissed without proper hearing, thereby forcing petitioners to go on appeal.

“Most of the cases on appeal are akin to being ruled to return to the Tribunal for hearing.

“This constitutes a waste of time which could force the petitions to die naturally since the Electoral Act provided a maximum of 180 days for all petition matters to be concluded both in the Tribunal and Appeal Court. “A waste of any time then could kill the petitions brought before her.”

It made it clear that the tribunal’s stand of denying itself jurisdiction over some petitions leaves much to be desired, as some pre-election matters based petitions like those on party primaries have been struck off on the issue of jurisdiction, whereas the Supreme Court had ruled that pre-election matters were within the jurisdiction of the Tribunal.
