AGF’s Advice on Kogi Election in Order-Ubani

Human right lawyer and former Chairman, Nigeria Bar Association (NBA) Ikeja branch, Barr. Monday Ubani has urged those who   are not satisfied with the advise gave by the Attorney General  (AGF) of the Federation on the inconclusive governorship election in Kogi State to go to court because he has not erred. 

“I don’t think the decision of the AGF to advise INEC on the replacement of the death of All Progressives Congress (APC) governorship candidate in the conduct of supplementary election in Kogi was wrong. Those against the advice especially the People’s Democratic Party (PDP) have the option of going to court on the matter,” he said.

Ubani further explained that as the chief law officer in the country, he is in better position to advise the electoral body in a situation where the candidate of a political died before the conclusion of the election. 

“I know that the constitution specifies the independence of INEC but in a situation like this they may not rely only on their own lawyers but need to seek further advice on the matter.”  

On the decision of PDP to go to court asking INEC to declare Idris Wada, candidate of PDP winner of the election, Ubani said it cannot happen because he was not the winner of the election.  I don’t think that can happen and we are waiting to see which court would deliver such judgment”.
